Frequently asked questions

My partner is Spanish. Can I live in Spain with them?

Yes. Spouses and partners of Spanish nationals can apply for a 5-year residence permit with full work rights. If you're not married, you'll need to show a stable relationship.

My partner is Spanish but has lived in Australia for years. Is that a problem?

No — moving to Spain together is exactly what this permit is for. Check that your partner's Spanish documents, such as their passport and consular registration, are up to date.

My mum or dad was born in Spain. Does that help me?

Very likely. Children of a parent who is or was Spanish by origin can qualify for this permit — and may also be eligible for Spanish nationality.

Can I work straight away?

Yes. If you apply from inside Spain, you can work from the moment your application is accepted for processing.

What changed in 2025?

Until May 2025, family of Spaniards used the EU family card. Spain's new immigration regulation created a dedicated permit for them. If you already hold an EU family card, it stays valid until it expires.
